Terms of Use

Use of the Youth Trends research service including online access (Youth Trends Online) is subject to a dated and signed subscription agreement form. A breach of the subscription agreement or these terms of use could result in a termination of the subscription agreement.

Subject to a signed subscription agreement, Youth Trends grants to you a limited, nonexclusive, nontransferable license to use the Youth Trends research portfolio for your business purposes. No installation, implementation, customization, consultation or related support services are included within this scope of these terms of use. Any such services Youth Trends may provide to you are set forth within the subscription agreement. RIGHTS NOT EXPRESSLY GRANTED HEREIN ARE RESERVED BY YOUTH TRENDS.

Access Controls: The subscription agreement limits the number of users who are allowed to access Youth Trends Online. You are required to take reasonable measures to protect access information and to assure that you do not permit unauthorized use of or access to Youth Trends Online. Youth Trends may audit your use of Youth Trends Online to assure compliance with access restrictions and will pursue all available remedies for a breach of these access rules.

COPYRIGHT NOTICE AND RESTRICTION ON USE OF CONTENT: The content, including the written materials as well as all supporting data and analysis is the intellectual property of Youth Trends. All rights of Youth Trends are reserved. You may download and republish Youth Trends data and analysis for republication upon receipt of express written consent form from Youth Trends. Under the terms of republication, you shall agree that you will not change any Youth Trends deliverable data or create your own derivative work from any portion of the Youth Trends deliverable. All republished Youth Trends data should be attributed to Youth Trends, Inc. If deliverable data from Youth Trends is not used according to these policies, then you may be in violation of the subscription agreement and be subject to termination of the subscription agreement and damages for the copyright violation under federal statutes.

CONTENT FROM OTHER SITES: On occasion Youth Trends will upload links to third party sites to your client folder within Youth Trends Online. These other sites may send to users their own cookies, collect data, solicit personal information or contain information that you may find inappropriate or offensive. We make no representations concerning the content of sites we may reference or their respective privacy policies. We cannot be held responsible for the accuracy, relevancy, copyright compliance, legality, or decency of material contained in sites referenced.

DISCLAIMER AND LIMITATION OF LIABILITY: Youth Trends attempts to assure the accuracy and timeliness of all information provided within the deliverable inclusive of Youth Trends Online. However, the nature of the information reported is subject to change. The information in your Youth Trends Online site is provided “as is” and without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. We do not warrant or make any representations regarding the deliverable, or the application to any use by you. We do not endorse any of the references we may on occasion link to, or any of the information contained in such third-party sites.  We are not liable under any circumstances, including, but not limited to negligence, for any direct, indirect, incidental, special, or consequential damages that results from the use of, or the inability to use, Youth Trends Online even if we have been advised of the possibility of such damages. If the applicable law does not allow the limitation of exclusion of liability or incidental or consequential damages, our total liability to you for all damages, losses, and causes of action (whether in contract, tort, including, but not limited to, negligence, or otherwise) may not exceed the amount paid by the party under the subscription agreement, if any, for accessing Youth Trends Online.

These Terms of Use, and their validity, construction and effect, shall be governed by and enforced in accordance with the internal laws of the State of New Jersey without reference to the conflicts of laws provisions therein. You specifically and irrevocably consent for any claims or disputes arising out of your use of the Youth Trends deliverable and Youth Trends Online or these Terms of Use to the jurisdiction of, and venue in, the federal or state courts sitting in New Jersey.
